THIS NOTICE DESCRIBES HOW YOUR HEALTH INFORMATION AND WEBSITE INFORMATION MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS IT. PLEASE REVIEW IT CAREFULLY.
Resilient Pathways Therapy is committed to protecting your Protected Health Information (“PHI”).
This is a solo behavioral health practice operated by a dual-licensed provider holding both a Licensed Professional Counselor (LPC) and Licensed Chemical Dependency Counselor (LCDC) credential in the State of Texas.
Services may include mental health counseling, psychotherapy, and substance use counseling within the provider’s scope of practice.
We are required by law to:
• Maintain the privacy and security of your PHI
• Provide this Notice of Privacy Practices
• Follow the terms currently in effect
• Notify you if a breach of unsecured PHI occurs
We may update this Notice at any time. Changes apply to all PHI we maintain.
We may use or disclose your PHI without your written authorization for the following purposes:
Treatment, Payment, and Health Care Operations
• Counseling and psychotherapy services
• Substance use counseling services when applicable
• Care coordination with other providers
• Clinical consultation
• Billing and payment processing
• Practice operations and quality improvement
Legal and Safety Requirements
• Court orders, subpoenas, and legal proceedings
• Law enforcement when required by law
• Mandatory reporting (abuse, neglect, or danger to self/others)
• Public health and safety requirements
We will obtain your written authorization before:
• Using or disclosing psychotherapy notes (with limited legal exceptions under HIPAA)
• Using PHI for marketing purposes
• Selling PHI
If you pay in full out-of-pocket for a service, you have the right to request that we do not share that information with your health insurance plan.
We will honor this request unless:
• Required by law
• Necessary for emergency treatment
• Otherwise legally mandated
You have the right to:
• Access and obtain copies of your records (excluding psychotherapy notes)
• Request corrections to your records
• Request restrictions on certain uses or disclosures
• Request confidential communications
• Receive an accounting of disclosures
• Obtain a copy of this Notice at any time
This practice is operated by a dual-licensed behavioral health provider:
• Licensed Professional Counselor (LPC)
• Licensed Chemical Dependency Counselor (LCDC)
License verification is available through the Texas Behavioral Health Executive Council (BHEC).
You have the right to request and receive a copy of your mental health records. To obtain your records, submit a written request to your provider via email, secure portal, or mail. This is in accordance with Texas Health & Safety Code §611.0045.
Your provider has 15 days to respond to your written request, in accordance with Texas Health & Safety Code §611.008(a).

You will not be retaliated against for filing a complaint.
